RESIDENTIAL / LEASE BERTHS GUIDANCE NOTES

GUIDANCE NOTES - PLEASE ENSURE YOU READ THE RELEVANT SECTION FOR THE BERTH YOU OCCUPY

The following guidance notes are designed to help you understand the boat registration and sub-let process.  They may be amended and altered from time to time in the interests of good estate management.

25YR LEASE BERTHS / L&M BERTHS / P-BERTHS

IF YOU OWN THE VESSEL THAT WILL OCCUPY YOUR BERTH

  • The vessel must be registered to that berth (only one vessel may be registered to a lease berth at any one time).
  • A Licence shall be granted for use of the berth upon arrival of your vessel and the owner (the Lessee) shall also provide full particulars of the vessel together with a copy of the current Certificate of Insurance and proof of ownership of the vessel. The Registration Fee of £65.00 is payable at that time.
  • Premier Marinas must hold on file a copy of a valid insurance certificate for the occupying vessel and this includes any policies that may expire part way through a Licence period, in which case evidence of renewal of the policy must be forwarded to Premier Marinas Ltd. It remains the berth owners responsibility to ensure that this is always the case, so copies of renewal documents must be sent to Premier Marinas
  • The Registration Fee with effect from 1st January 2009 is £65.00 including VAT. As stated, this fee is payable to enable consent for the vessel to occupy the berth. Please note, this registration fee is applied to each vessel that occupies the berth or every time the vessel changes.

  • Only one vessel may be registered to a lease berth at any one time
  • A valid Licence is required to Sub-let the berth in accordance with the provisions of the Sub-Underlease and full details of the occupying vessel and its owner(s) must be provide to enable the appropriate documentation to be fully completed. The Licence protects you as the berth-owner, Premier Marinas and the lessee (much as a tenancy agreement protects a landlord).
  • The Licence Fee with effect from 1st January 2009 is £65.00 including VAT and, as stated above, is payable for each Licence issued. This fee covers the cost of administering the Licences, updating records and is required in accordance with clause 3.9.3 of the lease.
  • Each Licence is only valid for a maximum of 364 days (no minimum period applies), and as stated each Licence must be accompanied by the Licence Fee.
  • Premier Marinas must hold on file a copy of the valid insurance certificate for the occupying vessel. This includes any policies that may expire part way through a Licence period, in which case evidence of renewal of the policy must be forwarded to Premier Marinas Ltd prior to expiry.
  • Please note that it is the berth-owners responsibility under the terms of the lease to ensure that documentation relating to the use of the berth is correctly administered, namely:

a) Boats are correctly registered to the berth

b) Licences to Sub-Let are completed in advance and must remain valid for vessels to occupy the berth. Retrospective Licence will not be accepted.

c) Copies of the vessels Insurance documentation must be held by Premier Marinas Limited and that insurance must be maintained at all times and shall be in the sum of at least £2,000,000 Third Party Liability (or such greater sum as may be specified in accordance with the Marina Rules and Regulations).

d) Appropriate fees must be paid in advance

Other points to note:

  • If any details of either a sub-lessee or berth owner change, including contact information, then Premier Marinas must be informed immediately. It is in the interest of all parties that Premier Marinas are kept fully aware of any changes to ensure that communication is maintained with each and every vessel's owner whether owned or sub-let
  • No part completed Licence to Sub-let will be accepted
  • Failure to comply with these obligations could result in the occupying vessel being removed to the public marina where it will immediately begin to accrue berthing fees at the prevailing visitor rate.

These private berths are managed by POSOL, please contact them to register Tel: 023 9287 6755 Website: www.posol.co.uk.  

The relevant forms will be sent to you on request and once POSOL have confirmed that the appropriate documents have been presented they will inform Premier Marinas that the vessel is registered and a numerical pennant will then be issued.  The vessel owner has 21 days from date of arrival in the marina to complete registration with POSOL, failure to do so will result in the vessel being unable to transit the lock and visitor charges being applied by Premier Marinas Ltd.
